Died of Wounds (Accidental) 7 Dec 1944 - Accidental GSW Chest and Abdomen

On the 7th Dec 44, at approx 1710 hours, F-82392 ,Pte Morrison A.L. Nova Scotia Highlanders, was cleaning his rifle in a room on the second floor of a house which his platoon was billetted. After cleaning his rifle, he charged the magazine and shoved the bolt forward squeezed the trigger. The rifle went off. At the time of diseharge the rifle was pointing toward the floor. As the result of the rifle, Pte Guillemette L.T was wounded in the stomach and died as the result of wound received.
Evidence corroborated.

The Court reports that
(i) E.. 52873 Pte Guillemette, L.J. wàs accidently shot by a round fired from a rifle in the hands of F. 82392 Pte Morrison A.L
(ii) F. 82393 Pte Morrison A.1. was negligent in the handling of his rifle
(ill) Pte Guillemette was on duty at the time of the accident.

OPINION OF TILE BUE COND: In my opinion Pte Morrison, A.L. was careless in handling his rifle which resulted in the death of a comrade. I therefore direct that he be charged with manslaughter. I concur with the opinion of the CO (para 3). Pte Guillemette was not guilty of improper conduct.

OPINION OF MAJOR GEN: E32873 Pte GUILLETTE L J was not in any way to blame for the accident which resulted ii his death. F82392
Pte MORRISON A L was tried for manslaughter by FGGM and acquitted.
F 82392 Pte MORRISON, AL, was tried., for manslaughter by Field General Court Martial on 27 Dec 44 and acquitted.
